Legal Issues with Modular In-Law Suites

Before starting any design work on a modular home in law suite, you will need to make sure that their are no covenants or building restrictions to stop you. Some areas have restrictions on additions to be used as an in-law suite.

Common In-Law Suites, Restrictions and Requirements

Utilities - The utilities in many municipalities require utilities be shared with the prefab in law suite. This is to deter adding non family member occupants to home. This includes: gas; water; sewer; heat and air conditioning systems.

Entry Requirements - All of the occupants must be able to use a common entry. In addition the modular addition can't have it's own separate exterior door.

Partitions and Doors - The unit must not be blocked off from the main floor plan of the house with a door or wall. The suite must be an integral part of the home and not be disconnected of blocked.

Appearance - The modular home addition or freestanding structure must appear to be part of the original home. This means that the exterior of the home must appear as though the home and the modular addition were built at the same time. This often will require new siding and roofing for the existing home which will drive the cost of an in-law suite up thousands of dollars.

Occupants- The occupants of an modular in law suite must be a family member. Children, parents, brothers and sister can occupy the addition, but no renters.

Size Restrictions - Often municipalities will restrict the overall foot print and floor plan size of the in law suite to a percentage of land. Or, the size of the in-law suite will be restricted to a certain square footage.
